Kratom is not banned statewide in Colorado. Instead of a total ban, Colorado enacted comprehensive state regulations governing the manufacture, sale, and distribution of kratom products.
Statewide Regulation Framework
- Statutory Law: Under Colorado SB25-072 (the Daniel Bregger Act), natural botanical leaf kratom remains legal for adults aged 21 and older.
- Synthetic & Extract Restrictions: The law strictly prohibits the manufacture, distribution, or sale of synthesized/semi-synthesized alkaloids and caps 7-hydroxymitragynine (7-OH) concentrations at a maximum of 2% of total alkaloid content.
- Consumer Protection Standards: Requires clear product labeling, mandatory third-party testing, and proper registration with state authorities.
Local Municipal Bans
Statewide legality does not override municipal prohibitions. Several Colorado municipalities enforce local bans or sale restrictions:
- Denver: Prohibits the sale of kratom for human consumption within city limits.
- Parker: Banned the sale and display of all kratom products within town limits.
- Monument: Enacted an ordinance prohibiting the sale, manufacture, and distribution of kratom.
- Greenwood Village: Enacted municipal restrictions prohibiting the sale of kratom products.
