This is the “Kratom Product Regulation” bill, similar to the Kratom Consumer Protection Act seen in other states. It is currently the leading piece of legislation.
Funding: Appropriates funds for the Department of Agriculture to hire a tester and purchase equipment to ensure products on shelves are pure
Status: As of February 26, 2026, it passed the House Judiciary Committee unanimously and is moving to the House floor. It previously passed the Senate.
Age Restriction: Prohibits the sale or delivery of kratom to anyone under 21 years of age.
Consumer Safety: * Bans adulterated kratom (mixed with controlled substances).
Bans synthetic or semi-synthesized alkaloids.
Limits 7-hydroxymitragynine to no more than 2% of the total alkaloid content.
Labeling Requirements: Products must include serving sizes, total alkaloid counts, and a disclaimer that the FDA has not evaluated the product.
Penalties: Violations would be a misdemeanor punishable by up to one year in jail and/or a $1,000 fine.
