Natural plain leaf kratom remains legal statewide in Florida for adults 21 and older, but the state maintains strict bans on isolated derivatives and local prohibitions in select areas.

State Enforcement & Regulatory Framework

  • Targeted 7-OH Restrictions: The Florida Department of Health and Attorney General’s Office issued emergency rules placing isolated 7-hydroxymitragynine (7-OH) and synthetic derivatives (such as mitragynine pseudoindoxyl, 7-acetoxymitragynine, MGM-15, and MGM-16) into Schedule I controlled substance status.
  • Alkaloid Limits: Retail products are prohibited from containing more than 1 mg of 7-OH per gram or milliliter, and must maintain a minimum 100:1 mass ratio of raw mitragynine to 7-OH to effectively ban high-potency, chemically altered extracts.
  • Age Limits: Under state law (F.S. 500.92), selling or delivering kratom products to anyone under 21 years of age is illegal statewide.
  • Legislative Action: Proposed state Kratom Consumer Protection Act bills (such as SB 994 / HB 1205) died in committee during the 2026 legislative session, leaving administrative rules and existing statutes as the primary governing bodies.

Local County & City Bans

Sarasota County: A complete local ban remains in effect throughout Sarasota County (including the city of Sarasota). Under local county ordinance, kratom is classified as a synthetic drug, making possession, sale, and distribution illegal.

Manatee County: Discussed a local ordinance in late 2025 following Sarasota’s model, but county staff put the proposal on hold to monitor statewide regulatory actions.

Ocala (Marion County): Proposed a city/county-level sales ban in July 2026. However, the city council only directed staff to draft an ordinance; no final municipal ban has been enacted or signed into law yet.

Previously mentioned, Doral & St. Lucie County: Neither location has passed a local ordinance banning natural kratom leaf.

As of late August 2026, Sarasota County is the only local jurisdiction in Florida with a full, active municipal ban on natural kratom leaf.
