I am writing to you today as a concerned constituent to respectfully urge you to oppose HB 4641, which seeks to classify kratom as a Schedule I controlled substance. While I understand the committee’s goal of ensuring public safety, a total ban would remove access to a botanical product that many South Carolinians rely on for their well-being.
Instead of criminalization, I urge the committee to support sensible regulation. South Carolina has already seen progress with the Kratom Consumer Protection Act (KCPA), specifically through S 0221 and HB 4030.
Rather than a ban, regulation ensures:
- Product Purity: Protecting consumers from contaminated or adulterated products.
- Age Restrictions: Ensuring these products are only available to adults 18 or 21 and older.
- Labeling Standards: Requiring clear ingredient lists and usage guidelines.
- Tax Revenue: Maintaining a legal, regulated market that contributes to the state economy.
A ban via HB 4641 would unfortunately create an unregulated underground market and penalize law-abiding citizens. I ask that you protect consumer rights and public health by favoring the regulatory framework provided in the KCPA and HB 4648 instead of a Schedule I classification.
